User Agreement

This User Agreement (hereinafter referred to as "this Agreement") is entered into by and between you (or "User", referring to individuals or organizations who register, log in, use, or browse this service) and Beijing Manman Xingtu Technology Co., Ltd. and its affiliates (hereinafter referred to as "MipMap" or "we") regarding the products and services provided.
MipMap hereby especially reminds users to carefully read and fully understand each clause of this Agreement, including exemption or limitation of MipMap's liability and restrictions on users' rights. Please read carefully and choose to accept or not accept this Agreement (minors should read it accompanied by a legal guardian). If you have any objections to any clause of this Agreement, you may choose not to use MipMap's products and services.
1. MipMap Products and Services
1.1 Overview: You may use MipMap products and services to reconstruct and analyze your datasets, as well as upload them to the cloud platform or web-based platforms, including MipMap's cloud platform.
1.2 You must acknowledge and confirm:
1.2.1 Due to business development needs, we may unilaterally change, suspend, restrict, terminate, or revoke all or part of the content of MipMap products and services at any time without notice. Users must bear this risk;
1.2.2 MipMap products and services may include advertisements and other activities. Users agree to display advertisements and other activities provided by us, our affiliates, third-party suppliers, and partners during use;
1.2.3 We have the right, at our sole discretion, to stop transmitting any content that violates relevant laws and regulations or this Agreement, or infringes, impairs, or threatens anyone's rights or safety, and have the right to take appropriate legal action against any person who violates this Agreement, including but not limited to deleting illegal, infringing, or inappropriate content from MipMap products and services, terminating the violator's login qualifications, preventing them from using all or part of MipMap products and services, and retaining relevant information and providing reports to relevant authorities as required by laws and regulations.
2. User Registration and Account
2.1 Registration and Account:
2.1.1 Account Registration
You may need to register a user account and log in as required by us before you can use our products or services. According to the relevant provisions of the "Regulations on the Administration of Mobile Internet Application Information Services", users registering in China must bind a mobile phone number registered in their real name to successfully register a user account. At the same time, you need to provide relevant real personal information on the registration page, including but not limited to your name, email, contact number, etc. Users registering in other regions need to provide an email address. We may use the above information to send you business notifications (including bills), business communications, product promotions, and introductions.
2.1.2 Account Use
Your account is for your personal use only and may not be transferred, rented, sold, or authorized for use by others. If abnormal usage is detected, the platform has the right to suspend or terminate the use of the account. If you find that your account has been stolen or there are other security issues, please notify us immediately so that appropriate measures can be taken.
2.1.3 Account Cancellation
You may apply to cancel your account by contacting customer service or using the tools provided by the platform. After account cancellation, we will delete or anonymize your personal information as required by law, but relevant records may be retained for a period of time as required by law.
2.1.4 Invoice Issuance
For users in China, after you complete registration and select specific services, we will collect invoicing information including but not limited to name, taxpayer identification number, etc., and invoice recipient information including name, contact number, address, postal code, etc., for the purpose of issuing and sending invoices to you. We will issue and send invoices based on the above information and ensure the security and confidentiality of the information.
2.2 Customer Notification and Presumption
2.2.1 Service Notification
To provide you with better services, we may send you the following information via email, SMS, in-app messages, or other means: important notifications such as account registration and password reset; service-related reminders such as order status and transaction information; platform updates, policy adjustments, or security alerts. Such service notifications are part of the service and you may not be able to unsubscribe.
2.2.2 Marketing Promotion Notification
We may send you promotional activities, promotional information, or personalized recommendations via SMS, email, or other means. If you do not wish to receive such marketing information, you can unsubscribe by replying "TD" to the SMS or other specified codes; clicking the "unsubscribe" link in the email; or turning off relevant notification permissions in the app settings.
2.2.3 Unsubscribing from Promotional SMS
Unsubscribe method: Each promotional SMS will include a clear unsubscribe method (such as replying "TD" to unsubscribe). You can also contact customer service to unsubscribe from promotional SMS.
Unsubscribe scope: Unsubscribing only applies to marketing and promotional information and does not include service-related notifications (such as order confirmation, payment reminders, etc.).
Processing time: We will process your unsubscribe request as soon as possible, usually within 48 hours. However, due to technical or other uncontrollable reasons, you may still temporarily receive information. Thank you for your understanding.
Resubscribe: If you wish to receive promotional SMS again after unsubscribing, you can contact customer service or re-enable relevant notification permissions in the app.
2.3 You must promise and guarantee:
2.3.1 You understand and agree that MipMap is an application service product. Users are fully responsible for the authenticity, legality, and validity of registration information; users may not impersonate others, use MipMap products and services in the name of others, or publish any information; users may not maliciously use registered accounts to mislead other users; otherwise, we have the right to immediately stop providing any services, including MipMap products and services, and you shall bear all legal responsibilities arising therefrom;
2.3.2 Your use of MipMap products and services must be legal, and you are responsible for all actions under your registered account, including any content you publish through MipMap and any consequences arising therefrom. Users should judge the content and functionality at their own discretion and bear all risks arising from use, including risks arising from reliance on the correctness, completeness, or usefulness of the content and functionality. MipMap cannot and will not be liable for any loss or damage caused by user actions;
2.3.3 You are responsible for keeping your login information confidential and not allowing others to obtain and use it, and for all actions under your MipMap account. You must notify us immediately of any unauthorized use or suspected unauthorized use that may violate the law. We are not responsible for any loss caused by your failure to comply with the above requirements.
2.3.4 The information you publish through MipMap is public information, and third parties can obtain the information you publish through this platform. By publishing any information, you acknowledge that the information is public and bear legal responsibility for this behavior; any user who does not want information to be known by others should not publish it on this platform.
3. User Content
3.1 User Content:
User content refers to all content generated by the user when downloading, publishing, or otherwise using MipMap products and services. You are solely responsible for your user content and bear the risk of you or any third party being identified due to the disclosure of your user content.
3.2 License:
By uploading, publishing, distributing, or otherwise using your user content in MipMap products and services, you are deemed to automatically grant and warrant that you have the right to grant us an irrevocable, non-exclusive, royalty-free, and fully paid-up worldwide license.
3.3 Third-Party Content:
MipMap products and services contain user content provided by other users. Your interaction with other users is solely between you and other users. MipMap does not control and is not legally responsible for such user content, nor is it obligated to review, monitor, approve, or verify such user content. You bear legal responsibility for the risks arising from the use of such user content and interaction with other users, and MipMap assumes no legal responsibility for such behavior.
4. User Rights and Obligations
4.1 The right to legally use MipMap products and services;
4.2 The right to download, install, and use MipMap products and services on your legally owned devices;
4.3 The ownership of user accounts belongs to MipMap and its affiliates. For account security reasons, it is prohibited to use other people's mobile phone numbers, email addresses, ID numbers, or bank accounts to register MipMap accounts. After you complete the registration procedures, you obtain the right to use the MipMap account, which belongs only to the initial applicant and may not be given, lent, rented, transferred, or sold. MipMap has the right to reclaim user accounts as needed for business operations;
4.4 You have the right to change or delete your personal information, registration information, and published content on MipMap, but please note that deleting relevant information may also delete any text and images you have stored in the system. Users must bear this risk;
4.5 You are responsible for properly keeping your registered account information and password secure, and you are legally responsible for actions under your registered account and password. Users agree not to use other members' accounts or passwords under any circumstances. If you suspect that someone else is using your account or password, you agree to notify MipMap immediately;
4.6 Restrictions:
4.6.1 You may not license, sell, rent, transfer, distribute, or use MipMap content or MipMap products and services for any commercial purpose in any form;
4.6.2 You may not access MipMap or use MipMap products and services for the purpose of creating identical or competing services;
4.6.3 Unless expressly provided by law, you may not copy, distribute, republish, download, display, post, modify, translate, merge, utilize, decompose, or reverse engineer any part of MipMap products and services (including but not limited to content or advertisements or sponsored content in the products) in any form or manner;
4.6.4 You are legally responsible for the risks arising from your use of third-party websites and advertisements. When you access third-party websites and advertisements, the terms and policies of the third party apply;
4.6.5 By uploading, publishing, or otherwise using MipMap products and services, you agree to bear all legal responsibilities arising from the following behaviors:
Behaviors that undermine the basic principles established by the Constitution;
Endangering national security, leaking state secrets, subverting state power, undermining national unity; damaging national honor and interests; inciting ethnic hatred or discrimination, undermining national unity; undermining national religious policies, promoting cults and feudal superstitions;
Spreading rumors, disrupting social order, undermining social stability; spreading obscenity, pornography, gambling, violence, murder, terror, or abetting crime; insulting or slandering others, infringing on the legitimate rights and interests of others; containing other content prohibited by laws, regulations, and administrative rules;
Other behaviors that violate national laws or have a negative impact on society.
4.6.6 You agree not to engage in the following behaviors on or using MipMap products and services:
4.6.6.1 Uploading or publishing computer viruses, worms, malicious code, or software that intentionally damages or alters computer systems or data; collecting other users' information or data, such as email addresses, without authorization;
4.6.6.2 Disabling MipMap's network connection, causing excessive burden to MipMap, or otherwise interfering with or damaging website servers and network links;
4.6.6.3 Interfering with or disrupting other users' normal use of MipMap products and services.
5. Damages and Compensation
5.1 You must use MipMap products and services in accordance with laws, regulations, and this Agreement, and avoid MipMap suffering any complaints and/or lawsuits from third parties due to the following behaviors or related behaviors, and bear any losses, damages, liabilities, costs, and expenses (including but not limited to attorney fees) arising therefrom:
5.1.1 Your use of MipMap products and services;
5.1.2 Your user content;
5.1.3 Your violation of this Agreement.
5.2 You agree that unless you obtain MipMap's written consent, you may not unilaterally settle in lawsuits jointly filed by you and MipMap against third parties.
5.3 In any case, MipMap shall not be liable to you or any third party for any indirect, consequential, punitive, incidental, special, or exemplary damages arising from this Agreement. For the avoidance of doubt, you shall bear the risk of any damage to your computer system or mobile communication device database caused by accessing or using MipMap products and services.
6. Disclaimer
6.1 In the following circumstances, MipMap shall not bear any legal responsibility:
6.1.1 Monitoring, collecting, and providing your personal information in accordance with legal requirements, requirements of relevant government departments, or national security supervision requirements;
6.1.2 Any personal information leakage caused by your improper use or other personal reasons;
6.1.3 Any service interruption or obstruction that cannot meet user requirements due to hacker attacks, computer virus intrusion, illegal content information, harassment information blocking, government control, and other network, technical, communication line, information security management measures, etc.;
6.1.4 Users are subject to various penalties and losses for using MipMap products and services in violation of laws and regulations;
6.1.5 Users suffer losses due to third parties such as operator communication line failures, technical problems, network, computer failures, system instability, and other force majeure circumstances;
6.1.6 Risks caused by anonymous or impersonated information containing threats, defamation, offensive or illegal content from others when using MipMap products and services;
6.1.7 Any psychological, physiological, or economic losses caused or possibly caused by users being misled or deceived in their interactions with other users through MipMap products and services.
6.2 Any content published by users on MipMap does not represent or reflect any views or policies of MipMap, and MipMap assumes no responsibility for this.
6.3 In any case, MipMap shall not be liable for any indirect, consequential, punitive, incidental, special, or penal damages, including loss of profits suffered by users due to the use of MipMap products and services. Notwithstanding any contrary provisions in this Agreement, our total liability to you, regardless of the reason or form of action, shall not exceed the fees you paid to MipMap for using MipMap products and services during the registration period (if any).
7. Intellectual Property
7.1 When using MipMap products and services, users may not infringe on the intellectual property rights of any third party. Without the prior written consent of the relevant rights holder, users may not upload, publish, modify, disseminate, or copy any copyrighted material, trademarks, or proprietary information belonging to others in any way. If MipMap receives proper notice from any copyright owner or its legal representative, we will remove such infringing content after review.
7.2 The copyright of original content published by users when using MipMap products and services belongs to the user, and the user may authorize third parties to use it in any way. For content edited by multiple people, including but not limited to questions and supplementary explanations, answer summaries, topic descriptions, and topic structures, all participants agree that the relevant intellectual property rights belong to MipMap.
7.3 All content published by users when using MipMap products and services grants MipMap a free, irrevocable, non-exclusive license to use, and MipMap has the right to use such content in various forms on various MipMap products and services, including but not limited to websites, applications, media, or others.
7.4 The MipMap logo, product and service names, images, graphics, etc. involved in MipMap products and services are protected by copyright, trademark, and other laws. Without the prior written consent of MipMap, users may not display, use, or otherwise process the above content in any way, and no organization or individual may use, copy, modify, disseminate, copy, or bundle the trademark with other products for sale for any reason or in any way.
7.5 MipMap products or services contain content owned or licensed by MipMap (referred to as "MipMap Content"). MipMap Content is protected by copyright, trademark, patent, trade secret, and other laws, and between you and MipMap, MipMap owns and retains all rights to MipMap Content and MipMap products or services. You may not delete, alter, or remove copyright, trademark, service mark, or other proprietary rights notices attached to or contained in MipMap Content, nor may you copy, modify, adapt, perform, display, publish, distribute, transmit, broadcast, sell, license others to use MipMap Content, or create derivative works based on it, or otherwise use MipMap Content.
7.6 In particular, you understand and agree that all materials we provide (including but not limited to fonts, format styles, filters, stickers, watermarks, music, etc.) are only for use in short videos shot and edited through MipMap products or services and as part of such short videos. You may not separate the materials provided by us from the above short videos or use such materials separately in any form. You understand and agree that short videos shot and edited using the above materials through MipMap products or services may not be used for any commercial purpose.
7.7 In addition to the above provisions, if you believe that someone has copied and published your work on MipMap products and services and has infringed your copyright, please contact us in time and provide a written notice containing the following information:
Proof of your ownership of the allegedly infringing content;
Clear identification, address, and contact information;
The location of the allegedly infringing content on MipMap products and services;
A description of the copyrighted work you claim is infringed;
Relevant proof of your copyright being infringed;
A written statement declaring that the content described in your notice is accurate and true, under the premise of agreeing to bear the consequences of perjury.
8. Modification and Termination
8.1 Modification:
8.1.1 This Agreement may be changed. If this Agreement is changed, we will publish the updated Agreement on MipMap. Thereafter, continued use of MipMap products and services will be deemed as your knowledge and acceptance of such changes and agreement to be bound by the terms;
8.1.2 MipMap reserves the right to modify, retain, or close MipMap products and services at any time without notice;
8.1.3 You agree that MipMap shall not be liable to you or any third party for modifying, retaining, or closing MipMap products and services.
8.2 Termination:
8.2.1 This Agreement takes effect from the date you accept it and remains effective during your use of MipMap products and services until terminated in accordance with this Agreement;
8.2.2 Notwithstanding the foregoing, if you use MipMap products and services before you accept this Agreement, and if you know or should know and agree to this Agreement, then this Agreement will take effect from the first time you use MipMap products and services, unless terminated earlier in accordance with this Agreement.
8.3 If a user infringes on the copyright of a third party and MipMap receives notice from the copyright owner or its legal agent, MipMap reserves the right to terminate this Agreement.
8.4 Once this Agreement is terminated, your website account and the right to use MipMap products and services will be terminated. You should be aware that the termination of your website account means that your user content will be deleted from our active database. MipMap shall not be liable to you for the termination of this Agreement, including the termination of your user account and the deletion of your user content.
8.5 Any updated version of MipMap or future versions, updates, or other changes to MipMap products and services will be subject to this Agreement.
9. Miscellaneous
9.1 Feedback
Any suggestions (or "feedback") you provide to MipMap shall be deemed as a transfer of all rights in such feedback to MipMap, and you agree that MipMap has the right to use such feedback and related information in any reasonable manner. We will treat such feedback as non-confidential and non-proprietary.
9.2 Privacy Policy
9.2.1 Please refer to our "Privacy Policy", which is an inseparable and equally effective part of this Agreement. At all times, your information is processed in accordance with the "Privacy Policy".
9.2.2 MipMap will fully protect users' personal privacy information and guarantees not to disclose users' personal privacy information or non-public content stored by users when using the service to the public or third parties, except as required by law, authorized government departments, or with the user's prior explicit authorization. MipMap may need to disclose users' personal privacy information, including but not limited to flight data generated during the use of MipMap products and services.
9.3 Notification
You must provide a valid email address that you use frequently. MipMap is not responsible for any risks arising from the email address you provide being unavailable or for any reason we are unable to deliver notifications to you. Announcements and notifications published by MipMap and emails containing such notifications sent to you (if any) undoubtedly constitute valid notifications.
9.4 Governing Law
This Agreement is governed by the laws of the People's Republic of China. If a dispute arises between the parties, it should be resolved through friendly negotiation; if negotiation fails, a lawsuit should be filed with the court where MipMap is located.
9.5 Severability
If any provision of this Agreement is found to be unenforceable, the other provisions of this Agreement will continue to apply, and the unenforceable provision will be modified to the extent necessary to make it enforceable by law.
9.6 Entirety
This Agreement (including the Privacy Policy) is the final, complete, and exclusive agreement between you and MipMap regarding matters related to MipMap products and services, and supersedes and merges all previous discussions and agreements between the parties regarding such matters (including previous end-user licenses and terms of service).
9.7 Titles
The titles of each section are for convenience of reading only and have no legal or contractual obligations.
9.8 Assignment
Unless with the written consent of MipMap, you may not assign the rights and obligations stipulated in this Agreement. Any attempt to assign in violation of the above provisions is invalid.
Your registration, login, use, and publication will be deemed as acceptance of this Agreement and agreement to be bound by all terms of this Agreement.
By accepting this Agreement, you voluntarily accept all terms, including accepting any modifications made by MipMap to any clause at any time. This Agreement may be updated by MipMap at any time. Once the updated terms are published, they will replace the original terms without further notice. Users can view the latest terms on MipMap. After MipMap modifies the relevant terms of this Agreement, if the user does not accept the modified terms, please stop using MipMap products and services immediately. Continued use of MipMap products and services will be deemed as acceptance of the modified Agreement.
